We are a retail and online custom apparel business producing custom clothing, spirit wear, promotional merchandise, and bulk contract orders for schools, businesses, organizations, and individuals.

2. Use of Website

By using this Website, you agree to:

We reserve the right to refuse service or terminate access for misuse, fraud, or policy violations.

3. Orders & Production

All custom items are made to order. Production begins after payment is received and any required proof is approved.

Turnaround times are estimates and not guarantees. We are not responsible for delays caused by supply shortages, carrier delays, weather, or events beyond our control.

For booster club or spirit wear stores, items are preorder only and produced after the store closes. Orders may be distributed through a designated representative.

4. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice.

Full payment is required before production begins unless a written contract states otherwise. Bulk and contract orders may require a non-refundable deposit.

We reserve the right to cancel orders due to pricing errors, suspected fraud, or inability to fulfill the request.

5. Artwork & Intellectual Property

Customers who upload artwork, logos, or designs represent that they own or have permission to use the submitted materials.

All original designs, layouts, mockups, artwork files, and production methods created by Premium 509 Designs remain our intellectual property unless otherwise agreed in writing.

You may not reproduce, resell, or modify our designs without written consent.

6. Proof Approval

If a proof is provided, customer approval confirms accuracy of spelling, design placement, sizing, and colors. Once approved, we are not responsible for errors.

7. Returns & Refunds

Due to the custom nature of our products, all sales are final once production begins.

We do not offer refunds or exchanges for incorrect size selection, color choice, or approved designs.

If an item is defective due to our error, you must notify us within 7 days of receipt or distribution for review and resolution.

8. Shipping & Pickup

Shipping times are estimates and not guaranteed. We are not responsible for carrier delays, lost packages marked delivered, or incorrect addresses provided by the customer.

Local pickup may be available. Booster club orders may be distributed by designated representatives.

9. Chargebacks & Payment Disputes

By completing a purchase, you agree to contact Premium 509 Designs before initiating a chargeback.

We reserve the right to dispute fraudulent chargebacks using proof of approval, communication records, and production documentation.

10. Limitation of Liability

Premium 509 Designs shall not be liable for indirect, incidental, or consequential damages arising from use of our Website or products.

Our total liability shall not exceed the amount paid for the product in question.

11. Privacy

Use of this Website is also governed by our Privacy Policy. We collect and use customer information only as necessary to process orders and operate our business.
